Listed on the FICP: removing your name from the register, then preparing your mortgage

While listed on the FICP, a mortgage is refused almost everywhere. Check the entry, regularise the situation, have the removal confirmed, then reapply.

Being listed on the FICP does not legally prevent you from obtaining a mortgage, but it amounts to a refusal in the vast majority of institutions while the entry remains active. The realistic approach: check your entry yourself with the Banque de France, pay the debt in full to the reporting institution, have the removal confirmed, then allow several months of statements without incident before submitting your application.

Key points

  • Being listed on the register does not legally prevent you from obtaining a loan, but it amounts to a refusal in the vast majority of institutions while the entry remains active.
  • Consulting the register is strictly personal: neither a relative nor an intermediary can do so on behalf of the listed person.
  • For a repayment incident, removal takes effect as soon as the institution that made the entry declares the debt has been paid in full.
  • An entry linked to over-indebtedness follows the duration of the plan or measures: settling a single debt does not lift it.
  • No paid “de-listing” service exists: only the payment of the debt to the reporting institution can lead to the removal of the entry.

If you are listed on the FICP, you will encounter a refusal of a mortgage loan almost everywhere. Do not submit an application: regularise the situation, have it recorded, and rebuild your profile. Other situations: atypical profiles and the refused loan.

FICP and mortgage loans: permitted by law, blocking in practice

The listing does not prohibit lending: the lender must consult the file, not refuse. In practice, it amounts to a refusal almost everywhere. The realistic path: eliminate the cause, then allow your accounts to demonstrate it.

Knowing if you are listed, and why

  • With the Banque de France, online, by post or by appointment: see its website.
  • Personal procedure: no one can do this on your behalf, nor can anyone require you to provide the document obtained.
  • Three responses: which file, which declaring institution, until when.

Never pay a third party for this verification.

FICP or FCC: the correct file

FICP FCC
What it records Repayment incidents on a credit, and over-indebtedness proceedings Cheque incidents and bank card withdrawals
Who declares The lending institution, or the over-indebtedness commission The bank holding the account
What it blocks in practice Any new credit Payment methods, and consequently credit

Late rent, unpaid invoices or authorised overdrafts are not recorded in it, but are visible on your statements.

What removes a record

Repayment incident: removal as soon as the institution declares full payment, and at the latest within the maximum period set by the code. Over-indebtedness: entry for the entire duration of the plan, within a maximum period also set by the text.

After an incident, removal depends on you; after over-indebtedness, it depends on the plan. In the meantime, build up savings.

Five steps before resubmitting

  1. Know: exercise your right of access.
  2. Regularise: pay everything owed to the declaring institution and request a written certificate.
  3. Verify: check a few weeks later that the entry has disappeared; if not, follow up, attaching the certificate.
  4. Rebuild: several months of statements without incident, with regular savings.
  5. Submit: complete file and a short, dated written explanation.

After removal: a file without grey areas

  • Present the project elsewhere than at the bank involved in the incident.
  • Explain in writing what your statements show: see what the bank looks at.
  • Conceal nothing: a false statement weakens the entire file.

False solutions to avoid

  • Paid 'record removal': only payment to the declaring institution removes an incident.
  • Credit 'without file consultation': a credit institution always consults.
  • Upfront fee advance: prohibited before the disbursement of funds. Check the registration: verify an intermediary.

Preparing the submission with me

  • Before the regularisation: read through the Banque de France document and date the project.
  • After the deletion: read your statements like an analyst; gather the documents.
  • At the submission: the explanatory note, and institutions that have not been aware of the incident.

Nothing is charged before the disbursement of the funds (fees). Right of access exercised? Prepare the next steps by telephone, with the document in hand.

Create your file as soon as the record is clear.
