Work stoppage and loan insurance: who to notify, within what timeframe, and what blocks the payment
Declaring a work stoppage to loan insurance, in the real order: the eight steps, the three documents always missing, and the only fatal deadline.
A work stoppage must be declared in writing to the insurer or its claims handler, not to the bank, within the contractual deadline stated in the policy. The deadline that cannot be recovered is the statute of limitations for actions against the insurer. Payment is most often blocked by a missing or incorrectly addressed document: daily allowance statements, employer’s certificate, medical certificate.

Key points
- The declaration must be made to the insurer or its claims handler, never to the bank, which is merely the beneficiary of the indemnity.
- The declaration deadline is contractual and is stated in the policy; a delay is only enforceable if the insurer proves actual damage.
- The truly dangerous deadline is the statute of limitations for actions against the insurer, which must be protected by registered mail with proof of receipt.
- The insurer’s medical advisor assesses the state of health in light of the contract’s definitions, not the stoppage recognised by social security.
- Loan instalments continue to be debited during the assessment period and the deductible; the indemnity arrives afterwards, with retroactive effect.
A period of incapacity for work must be declared in writing to the insurer, not to the bank. Provided the file is complete and sent to the correct recipient, the claim will be processed without the need for follow-up. Regarding guarantees and clauses: the borrower insurance file.
Declaring to the insurer within the notice period
To the insurer or the claims handler it designates. The bank receives the compensation but does not process the claim. The deadline is contractual: it is specified in the policy document, under the section on formalities in the event of a claim.
Where to find this section: how to read a policy document. Please also inform the bank, although this does not replace the formal declaration.
The only deadline that cannot be recovered
A forfeiture of rights due to late declaration is only enforceable if the delay caused prejudice to the insurer, and never in cases of accident or force majeure (Article L. 113-2 of the Insurance Code). The real danger is the statute of limitations.
Article L. 114-1 du code des assurances. En cas de sinistre, le délai ne court que du jour où les intéressés en ont eu connaissance, s'ils prouvent l'avoir ignoré jusque-là.

In the event of a disagreement, please write. A registered letter with proof of receipt requesting the payment of the compensation interrupts the statute of limitations (Article L. 114-2). A telephone call leaves no trace.
Correspondence that avoids follow-up requests
- Check the policy document: the time limit, the address of the claims handler, and the excess.
- Notify in writing, including the contract and loan numbers, and keep proof of posting.
- Initial medical certificate sent in a confidential envelope to the medical advisor, never to the bank.
- Statements of daily allowances, requested from the first month.
- Employer’s certificate (confirmation of salary maintenance), or income documents for a self-employed person.
- Amortisation schedule and repayment plan.
- Continue to pay: the allowance arrives later, often retroactive to the end of the excess period.
- Each extension of the period of incapacity, without waiting to be asked.
| Item sent | Recipient | What is blocked if missing |
|---|---|---|
| Dated notification of the claim | Claims handler designated in the policy document | The file does not exist; no time limit runs |
| Initial medical certificate | Medical advisor, in a confidential envelope | No medical assessment is possible |
| Statements of daily allowances | Claims handler | The calculation of the allowance remains open |
| Employer’s certificate or income documents | Claims handler | The loss of income is not established |
| Amortisation schedule and repayment plan | Claims handler | The basis for the allowance is not determined |
| Extensions of the period of incapacity | Claims handler | Payments stop part-way through |
| Notification of the opening of the file | The lender | Nothing legally, but avoidable follow-up requests |
Who decides on the acceptance of the claim
The insurer’s medical advisor, according to the definitions in the contract. A period of incapacity recognised by the social security body does not constitute acceptance of the claim.

Disagreement? The policy document generally provides for arbitration by a third doctor: read who pays for the expert opinion.
Difficult cases
- Therapeutic part-time work: the guarantee often requires total incapacity. Declare it anyway and read the definition before resuming work.
- Self-employed: attach your accounting records and tax notices when making the declaration.
- Sick leave that becomes disability: the transition is not automatic; request it in writing.

These penalties fall under the Lemoine Act, not an insurance claim. In the event of a dispute regarding coverage:
- the insurer's complaints department;
- the insurance mediator, free of charge;
- the judge, within the limits of the statute of limitations.
Two pitfalls before the first transfer
- The apportionment applies to the compensation: for a couple, the balance remains due (apportionment for couples).
- Do not change insurance during a claim (changing insurance, afterwards).
