Health questionnaire: when it truly disappears, and when it returns
The exemption is calculated per insured person, on their share of the cumulative outstanding balance: the table that tells you, person by person, if exempt.
The health questionnaire disappears when two conditions are met: an insured share, added across all of the insured person’s loans, below the ceiling set by law, and a final instalment date before the age limit fixed by the same text. The calculation is made per insured person, never per household. The questionnaire returns with a new loan, an extended term, an increased share, or a loan outside the scope of the text.

Key points
- The exemption from the health questionnaire requires two cumulative conditions: a ceiling on the insured share and a maximum age for the final instalment date.
- The calculation is made per insured person, on the insured share, added across all of the person’s loans, never per household.
- The exemption is never permanent: a new loan, an extended term or an increased share can cause it to disappear.
- The absence of a health questionnaire does not guarantee any price reduction: it pools the risk, it does not price it individually.
- A contract without a health questionnaire retains an application form and remains subject to the same exclusions as a standard contract.
The health questionnaire disappears when two conditions are met at the same time, calculated per insured person, across the entirety of their loans. Please verify whether you are exempt; the rest is in the borrower insurance file.
Is the health questionnaire truly abolished?
Yes, if your insured share of the outstanding balance of your loans remains below a legal cap and if the final instalment falls before a fixed age. No health questions or medical examination may then be requested.
Exactly what is the cap calculated on?
On the capital multiplied by your share, added up across all your ongoing loans, per insured person, never per household.
In a couple, the share determines the outcome
| The couple's situation | What each person bears | Consequence |
|---|---|---|
| Equal split, with no other credit | Half of the capital each | Each person is assessed on their half: the couple may be exempted on a capital far exceeding the limit |
| Full coverage on each head | The entire capital, twice | Each person is assessed on the entire capital: the limit is exceeded much sooner |
| Unequal split | A large share, a small share | One person may be exempted and the other not, on the same loan |
| An existing financed rental investment | The insured share of the previous loan is added | The cumulative outstanding balance may exceed the limit without the new loan being sufficient to do so |
First, choose the share to protect the surviving partner: the share in a couple.
When does the questionnaire come back?
With each new insurance application, the calculation is redone.
- The cumulative outstanding balance exceeds the limit, even by a small loan.
- The final instalment exceeds the age limit after an extension, a buyout or a deferral. Shortening the term may, conversely, exempt you.
- The share increases.
- The credit is out of scope: mortgage renovation loan, professional loan or consumer credit.
The application form: what remains
The health questions disappear, but not the form: occupation, sport, travel remain.
Answer with care, keep a copy, and read the seven exclusions to look for. Does a question seem medical to you? Request its basis in writing.
Does the absence of a questionnaire lower the price?
Not necessarily: without a questionnaire, the risk is mutualised. A good profile loses its advantage.
Have several contracts with equal guarantees priced and compare their annual effective rate of insurance.

The AERAS agreement is added to this: refusal, surcharge and AERAS agreement. After a surcharge, change insurance at any time: the Lemoine Act.
